On January 11th, 2018, the European Securities and Markets Authority (ESMA) published a ”Thematic Report on fees charged by Credit Rating Agencies (CRAs) and Trade Repositories (TRs)”, raising some concerns on the non-discrimination and disclosure requirements and the application of cost-related fees. ESMA’s supervisory review on this subject already pointed out that the current structures in the credit rating and trade repository activities needed further improvement and implementation. On the basis of the collected information, ESMA indeed maintains that there mainly are three areas of supervisory concerns that need improvement: transparency and disclosure, free-setting process and interaction with entities related to CRAs and TRs. Accordingly, ESMA is considering the hypothesis of increasing its supervisory guidance in order to obtain a better implementation of the required principles for CRAs and TRs fees.
