On 2nd March 2020, the European Securities and Markets Authority (ESMA) issued a report on C6 energy derivatives and related obligations in accordance with the European Market Infrastructure Regulation (EMIR). The importance of such derivatives is that they have a real impact on firms which are trading energy derivative contracts on coal and oil as well as on national regulator supervisors who are entitled and enabled to enforce all EMIR requirements. The function of the report is to assess the adequacy of mandating C6 energy derivative contracts, which at the moment benefit from a specific exemption rule, subject to the clearing obligation and margin requirements provided for by EMIR. ESMA has drafted its report in order to provide a new input to the European Commission regarding the assessment of the current special regime for C6 energy derivative contracts and a specific opinion on whether this regime should be preserved.
