On 26 March 2020, in the judgment C-215/18 in the so-called case “Primera Air Scandinavia”, the E.U. Court of Justice has specified that a passenger who has booked his flight through a travel agency can appeal to the air carrier before the judge of the place of departure of the flight to obtain compensation due to a prolonged delay of the flight, also in the absence of a contract between the passenger and the carrier.
The appeal falls, in fact, in the contractual matter on the basis of the regulation on jurisdiction, therefore it can be brought before the judge of the place of supply of the air transport service.
