On 18 June 2020, the E.U. Court of Justice, in the judgment of the case C-754/18, has ruled that the family member of a Union citizen who does not have the citizenship of a Member State but holds a permanent residence card is exempted from the obligation to obtain a Visa to enter the territory of the Member States. In addition, this card must be considered as suitable to certify the status of family member of its owner. It follows that the family member of a citizen of the Union who does not have the citizenship of a Member State, but who holds a permanent residence card, is exempted from the obligation to obtain a Visa to enter the territory of the Member States. It follows that the benefit of the Visa waiver provided for by Directive 2004/38 extends to the family members of a citizen of the Union who are in possession of a residence card or a permanent residence card both if that card was issued by a Member State which is not part of the Schengen area whether it has been issued by a Member State belonging to that area.
