On October 5th, 2020, the European Securities and Markets Authority (ESMA), the EU’s securities markets regulator, issued its final report on the Guidelines on portability of information between securitisation repositories; this report was based on the provisions of the securitisation Regulation. Specifically, the aim of the Guidelines that were commented by ESMA was to provide directions in the event that a securitisation repository should communicate information to another one. In accordance to what ESMA provided for in its public consultation, the Guidelines had to be made clearer for all market agents; following such instructions, the Guidelines were divided in two parts, a general part widely appliable to all data transfers and two annexes to be considered a specific part both for imposed data transfers from reporting entities and necessary transfers following an SR withdrawal from ESMA’s register. It appears that the report was generally supportive of the Guidelines contents and structure. On the same date, ESMA also published new Questions and Answers on securitisation topics. These Questions and Answers guidance on how to report certain underlying exposures which benefit from a COVID-related debt moratorium or payment holiday.
