15/04/2019 - ESMA grants continued access to three UK CCPS in case of a no-deal Brexit

On 18 February 2019, the European Securities and Markets Authority (ESMA) has communicated that in case of a no-deal Brexit there will be three central counterparties (CCPs), namely LCH Limited, ICE Clear Europe Limited and LME Clear Limited. Such decision, which has been expressed by the authority, was conceived in order to avoid any negative impact on the financial stability of the European Union. ESMA had already announced that the Board of Supervisors let free and continued access to UK CCPs, also in case of a no-deal Brexit; this resolution appeared in three subsequent statements that were issued on 23 November, 19 December 2018 and 4 February 2019. In relation to this, it is important to acknowledge that, not only ESMA guaranteed continued access to CCPs in accordance to EMIR provisions, but also it granted the same possibility to UK Central Securities Depository (CSD), which still have to be recognised though.
