The concept of “exclusive parental responsibility” is found in Appendix FM and Part 8 of the Immigration Rules. It must demonstrate that you have “sole responsibility” if you intend to bring a non-U.K. citizen to the United Kingdom to live with you and are applying for or have already obtained a limited residence permit as a partner under the FM Appendix; or has been granted a fixed-term permit to enter or remain under another path other than Appendix FM; or if you reside and are settled in the U.K. If you wish to join a child who is in the United Kingdom and who is a British citizen or has been settled in the U.K. for at least 7 years and cannot obtain a permit as a partner under the FM Appendix, they can rely on the sole responsibility. The burden of proof lies with the applicant. Usually, there are no problems when the parents live together in the U.K. or when only one of the parents is alive. However, in parenting arrangements where parents may have divorced or chose to live in different countries, for example, for work purposes, proving sole parental responsibility for the purposes of the Immigration Rules is quite difficult, even when both parents agree to relocate of child.
