Recently the Commercial and Property Court of England and Wales (Patent Court) was called to rule on a patent action filed for claims allegedly infringed by third parties in patents relating to a DNA sequencing technology: in the dispute the patent holder, the company Illumina Cambridge Limited, and the company responsible for the infringement, Latvia MGI Tech SIA & Ors of the Beijing Genomics Institute group opposed each other. The British Patents Court to decide on the validity of a patent applied the criteria of “common general knowledge of experts” and the “essence of the invention”.
