On March 1st, 2021, the European Securities and Markets Authority (ESMA), the EU’s securities markets regulator, decided to issue a new report, namely its Final Report, that aims at defining which information non-financial undertakings and asset managers have to give in order to be considered compliant with Article 8 of the Taxonomy Regulation and, specifically, with their disclosure obligations in accordance with the Non-Financial Reporting Directive (NFRD). In particular, the Report is structured with recommendations; amongst those, ESMA used a specific way to better define some concepts that are key for non-financial undertakings in order to calculate, for instance, the turnover KPI. The Chair of ESMA, Steven Maijoor, maintained that “Today’s recommendations on the KPIs for non-financial undertakings and for asset managers provide a solid basis for the European Commission to adopt an important element of the EU Taxonomy framework. ESMA’s advice sets out in concrete terms how to comply with the disclosure obligations under the Taxonomy framework, balancing investors’ demand for high quality information and avoiding undue burdens on market participants.”
