On July 1st, 2021, the European Securities and Markets Authority (ESMA), the EU securities markets regulator, concluded its first work concerning the analysis of the rules of the different member states on the marketing of investment funds in accordance with the Regulation on cross-border distribution of funds and the written report was presented to the EU Parliament, the Council and the EU Commission. In this new report, ESMA has provided the EU authorities with a specific analysis on the effects and consequences of the in-force regulations on the matter, in different forms, in different member states and specifically it based its work on the results and comments that were given by National Competent Authorities (NCAs) to two questionnaires prepared by ESMA. The report also showed that many NCAs had difficulties in providing data and analysis on the ex-ante or ex-post verification on marketing communications; ESMA’s work then proved quite useful to help give a direction on the matter. In two years then, ESMA will submit a new report on the same subjects.
