On July 20th, 2021, the European Securities and Markets Authority (ESMA), the EU securities markets regulator, published a second report on sanctions applied by National Competent Authorities (NCAs) but this time under the Directive on Alternative Investment Fund Managers (AIFMD); this second report refers to the year 2020. According to the report, in 2020, 17 NCAs imposed a total of 131 measures for sanctions, compared with the 87 sanctions issued in 2019, and the total amount of financial penalties was reduced to 3.3 millions, from 9 millions in 2019; the report also registers that 13 NCAs did use the power they have been award for that year. The report on the sanctions applied by NCAs under various directives normally shows a different approach by the National Authorities, specifically for what concerns the number of sanctions applied and the low level of the sanctioning activity at a national level.
