On 6 October 2021, the Court of Justice of the European Union, in the judgment of case C-538/19, ruled that medical treatment sustained in a Member State, other than that of residence, must be reimbursed in full even if the patient does not has obtained the authorization to be treated abroad from the competent health institution. In addition, it specifies that it is contrary to E.U. law, the obligation to submit, to obtain authorization, an opinion from the doctor of his own State of residence.
