On 24 February 2022, the E.U. Court of Justice - in its ruling on case C-389/20 - ruled on the failure to provide for the exclusion of a large number of female workers from access to social benefits, but also of workers, ruled that it constitutes indirect discrimination based on sex, the failure to provide unemployment benefits in Spain for domestic workers who, in fact, are overwhelmingly women. In this way, he recognized the indirect penalization based on sex, however, rejecting the exclusion of an entire category of workers.
