In accordance with the Schengen Borders Code, in the event of a serious threat to public order or internal security, Member States may carry out temporary checks at internal borders within the Schengen Area. However, the current rules of the Schengen Agreement are ambiguous in too many cases and the States often misinterpret them and, by this way, the rules are incorrectly applied. To remedy this situation and to establish clear rules, in a plenary vote on 29th November 2018 the European Parliament clarified that temporary border checks should be carried out only under exceptional circumstances and as a last resort measure. In particular, MEPs established that: the temporary border checks should be initially limited to two months instead of six; the maximum period for border checks should be limited to one year instead of two years; there should be more safeguards if checks are extended. The text was adopted by 319 votes to 241, with 78 abstentions.
