On April 5th, 2022, the European Securities and Markets Authority (ESMA), the EU’s securities markets regulator, communicated with the EU Commission on a possible review of EMIR for what relates to the attractiveness of EU markets for foreign investors. According to ESMA, in order to achieve the above-mentioned purpose, the EU should find a way to increase such attractiveness, such as the facilitation for entities clearing in the EU, and to improve the clearing obligation framework, as well as incentivize EU clearing participants to reduce their exposures to UK CCPs, enhance the EU supervisory framework for CCPs and mitigate risks remaining at UK CCPs. After the consultation, the EU Commission will draft a new legislative proposal in order to modify the EU central clearing framework.
