On 15 June 2022, the Privacy Guarantor - in the newsletter no. 491 - announced that private companies, public bodies, associations and all interested persons will have - until Monday 27 June 2022 - to send their comments and proposals for changes to the new guidelines, provisionally adopted by the EDPB (European Data Protection Board), on the penalties imposed for violations of the GDPR. The new rules proposed by the European Privacy Guarantors aim to harmonize the methods of calculating administrative penalties, to avoid unequal treatment between one European country and another, which is why an update of the methodologies adopted has been proposed. The guidelines also analyze whether the amount hypothesized for the sanction meets the requirements of effectiveness, dissuasiveness and proportionality provided for by the European regulation for the protection of personal data, distinguishing those who have made a single error from those who, instead, continue undeterred to violate the rules protecting the personal data of the interested parties, as sometimes happens in telemarketing or in other sectors. The final version of the new “guidelines of the calculation of administrative sanctions” will be defined by the European Privacy Guarantors within the EDPB at the end of the public consultation, taking into account the feedback sent by stakeholders to standardize the application methods of the GDPR throughout Europe.
