Starting from 1st August 2022 the new instrument of European judicial cooperation in family matters is applicable. It’s the E.U. Regulation no. 2019/1111 (so-called Brussels 2-ter) relating to the jurisdiction, recognition and enforcement of decisions in matrimonial and of parental responsibility matters and the international abduction of minors which repeals the old Regulation no. 2201/2003 (so-called Brussels 2-bis).

The provision provides, among other things, the abolition of the exequatur only for decisions relating to the right of access and return, a definition of a person of minor age and the child’s right to express the opinion. The strengthened incentive and the importance recognized to family mediation are significant.
