On 11 July 2022, the Italian Council of State, Fifth Section, with sentence no.5756 - reversing the ruling of the Lazio TAR that made news about a year ago - ruled that freedom of establishment has nothing to do with the specific question: a rental operator with driver (NCC) with head office in the E.U., in fact, cannot work in Italy with only the title obtained in his country, because national regulations apply in the field of transport, such as the Italian one which requires authorization of a specific municipality.
