On 1st August 2022, the Court of Justice of the European Union ruling with the Sea-Watch matter (in the joined cases C-14/21 and C-15/21) clarified that controls are legitimate and possible, but only after having saved human lives. So, it is possible to order a stop of a ship that rescues migrants and carry out checks, but they must demonstrate, in a concrete and detailed way, the existence of dangers to health, safety, working conditions on the ship and the environment, and not justify control only for the large number of people on board.
