On 19 May 2022, the Court of Justice of the European Union, with its ruling C-33/21, ruled that the staff employed by an airline established in a Member State, who work for at least 45 minutes a day in a premises located on the territory of another Member State, which coincides with the country of residence, is subject to the social security legislation of the latter State. This means that the flight crew of an airline established in a Member State, who is not covered by E101 certificates and who work for a period of 45 minutes per day in a space intended to accommodate the crew, of which that airline has in the territory of another Member State and who, for the remaining working time, is on board the aircraft, the social security legislation of the latter Member State is applicable.
