On 13 July 2022, with the decision on case T-227/21, the E.U. Court confirmed the legitimacy of the request for referral brought by France to the European Antitrust, which requested to examine the concentration between two American companies that deal with sequencing the genome. It should be noted that the operation - promoted by the Illumina company which had proceeded to the total acquisition of Grail - does not actually exceed the thresholds of Community significance but the negative effects on the market of the Member State can be examined. The transaction had not been notified either to the European Commission or to the Member States and those belonging to the European Economic Area.
