On September 23rd, 2022, the European Securities and Markets Authority (ESMA), the EU’s Securities Markets Regulator, issued a Final Report on Guidelines on certain aspects of the suitability requirements that are provided for in the MiFID II. Specifically, the improvements were concerned with various subjects amongst which the information to clients on the sustainability preferences, that shall be clear and understandable allowing clients to understand the concept of sustainability and the difference amongst products without the use of technical language. At the same time, the new guidelines also regard the collection of information from clients on sustainability preferences, which is now a duty of the firms, and the assessment of sustainability preferences, since the firm shall identify the products that fulfil the client’s sustainability preferences. Eventually, according to the guidelines, firms need to appropriately train their employees and staff on sustainability topics.
