On 24 November 2022, the Court of Justice of the European Union with sentence C-691/21 ruled that the user who suffers damage due to an electrical overvoltage due to a change in the voltage level made by the operator has the right to obtain compensation in the name of consumer protection, clarifying the delimitation between manufacturing and marketing processes, therefore deeming the European directive on liability for defective products applicable, considering that the manager of an electricity network must be considered as a producer.
